1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and MajorFactors LLC ("Major Factors," "we," "us," or "our"), governing your access to and use of the website majorfactors.health and all related telehealth services, including consultations, prescription fulfillment, and subscription programs for NAD+ therapy.

By accessing our website, creating an account, or purchasing any product or service, you agree to be bound by these Terms. If you do not agree, you must not use our services.

Our medical services are provided by Beluga Health, a licensed telehealth medical group. Prescriptions are filled by Pharmacy Hub, a US-licensed 503A compounding pharmacy. Your use of those services is also subject to their respective terms.

2. ELIGIBILITY

To use our services, you must:

  • Be at least 18 years of age
  • Be a legal resident of a US state where telehealth services are available
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from receiving NAD+ therapy or telehealth services under applicable law
  • Provide accurate, complete, and current personal and medical information

Service availability varies by state. We reserve the right to deny service to any individual who does not meet eligibility requirements.

3. ACCOUNT REGISTRATION

To access our services, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account
  • Keeping your personal, medical, and payment information up to date

We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or are used for fraudulent purposes.

4. MEDICAL SERVICES DISCLAIMER

Major Factors is not a medical provider, pharmacy, or licensed healthcare facility. We are a technology and wellness platform that facilitates access to telehealth services provided by Beluga Health and prescription fulfillment through Pharmacy Hub.

  • A licensed healthcare provider will evaluate your eligibility for NAD+ therapy during a telehealth consultation
  • Completion of payment and intake forms does not guarantee a prescription or medication dispensation
  • Individual results may vary; we make no guarantees regarding specific health outcomes
  • Our content is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment
  • If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately

5. SUBSCRIPTIONS AND PAYMENT

Major Factors offers subscription-based access to our telehealth and NAD+ therapy programs. By enrolling in a subscription, you authorize us to charge your payment method on a recurring basis according to the plan you select.

  • Billing Cycle: Subscription fees are billed monthly or quarterly as indicated at the time of purchase.
  • Automatic Renewal: Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the renewal date.
  • Price Changes: We may adjust subscription pricing with at least 30 days' advance written notice.
  • Failed Payments: If a payment fails, we may suspend your subscription until payment is resolved. You are responsible for any collection costs resulting from non-payment.
  • Taxes: Prices do not include applicable taxes, which may be added at checkout depending on your location.

6. CANCELLATION POLICY

You may cancel your subscription at any time through your account dashboard or by contacting our support team. Cancellation takes effect at the end of the current billing period. You will continue to have access to your subscription benefits through the end of the paid period. Please review our Returns & Refund Policy for information about refund eligibility.

7. PROHIBITED USES

You agree not to use our website or services to:

  • Violate any applicable law, regulation, or these Terms
  • Provide false, misleading, or fraudulent information during intake or consultation
  • Impersonate another person or misrepresent your identity
  • Attempt to gain unauthorized access to any portion of our systems or another user's account
  • Transmit any harmful, offensive, defamatory, or illegal content
  • Reproduce, distribute, or commercially exploit any content from our website without express written permission
  • Use automated tools (bots, scrapers) to access or extract data from our website
  • Interfere with or disrupt the integrity or performance of our services

8. INTELLECTUAL PROPERTY

All content on the Major Factors website, including but not limited to text, graphics, logos, images, and software, is the property of MajorFactors LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or create derivative works without our prior written consent.

9. DISCLAIMER OF WARRANTIES

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MAJOR FACTORS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAJOR FACTORS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CAUSE OF ACTION SHALL NOT EXCEED THE AMOUNTS YOU PAID TO MAJOR FACTORS IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless MajorFactors LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising from these Terms or your use of our services shall be resolved through binding arbitration in Cheyenne, Wyoming, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. CHANGES TO THESE TERMS

We may revise these Terms at any time by posting an updated version on our website. Material changes will be communicated via email or a prominent notice on our site. Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.
